Regulations for gift and incentive cards
Internal and external motivation schemes: what does the law say?
This English translation is provided for information only and refers to French law. In case of discrepancy, the French version prevails. All schemes may give rise to contributions. For those aimed at an internal sales force (your company's employees), the reward given to a salesperson who met their targets in a challenge is considered salary: it is therefore subject to the applicable employee and employer social contributions.
For a scheme aimed at a so-called “external” sales force (partner resellers, etc.), whether contributions are due, and how much, depends on several cases. For more information, write to us at btob@creacard.net.
Can I print my logo or a design on my Incentive, Corporate or White Label cards?
When you open your account, you can submit the design of your choice. It will be submitted for approval to Mastercard and our electronic money issuer. See the white label card.
How do I dispute a transaction?
If you notice an anomaly on a transaction, contact customer service on 01 80 96 18 18. Only fraudulent payments over €50 may be disputed with a view to a refund.
I don't have a works council (CSE): can I give my employees a PCS Incentive gift card?
You do not need a works council to subscribe to one of our PCS Pro offers. To find out more, fill in our contact form.
What is the flat-rate discharging contribution (contribution libératoire forfaitaire)?
According to interministerial circular DSS/5B no. 2012-56 of 5 March 2012, the discharging contribution is an overall proportional contribution, payable solely by the third party, and exclusive of any other payment, in particular employee social security contributions.
Who must declare and pay the contributions and the discharging contribution?
The amounts and values of goods or services granted must be shown on the recipient's payslip, under “Avantage en nature – cadeaux” (benefit in kind – gifts). This data is then sent to the Urssaf via the nominative social declaration (DSN). As an employer, you pay the employer contributions, and employees pay the employee contributions.
